Use of the trailermart.co.uk web site (The site) is conditional upon you accepting the terms and conditions set out below. If you do not agree to these terms and conditions do not access the trailermart.co.uk web site. All material on the World Wide Web site, located at the Internet address of http://www.trailermart.co.uk, is protected under United Kingdom and International copyright laws. No portion may be copied, reproduced, or redistributed in any manner, whatsoever, without specific consent or licensing from the copyright owners. Any and all other product and company names within may be the trademarks of their respective owners. All rights reserved OFFICIAL DISCLAIMER.
No submitted information shall be rented, sold, or given away to any third party businesses or individuals by the copyright owner. When placing an advert online we will never wilfully disclose any information about our visitors without first receiving the visitors’ permission.
However, since each ad is publicly viewed, there is no convenient solution to stopping malicious individuals and “spammers” from using the information in your advert(s) in a manner that you may not agree with. You agree that you will not use this site as a platform to promote your business or services by spamming advertisers in any way using our servers via the contact features within the site. We reserve the right to take all necessary legal steps to pursue spammers to protect our advertisers from illegal spamming activity.
Businesses which have placed advertising on this site may also collect information about you when you view or click on their ads or links. We do not have control over the collection of that information. You should contact those advertisers directly if you have any questions concerning your privacy and their advertising.
Trailermart.co.uk is operated by Niche Websites Ltd (hereinafter referred to as the company). The company grants you a personal, non-transferable license to use this site to view, read, print (for your personal reference), access and download (for your personal reference) classified advertisements. Advertisements can be entered onto the site subject to the conditions below.
The Company may suspend or terminate access to the site at any time. Should a suspension last more than 7 days, the company shall at its discretion either extend the display period for any paid advertisements, or refund any monies paid pro-rata for the part of 28 days that the advert was not displayed. No refunds will be given for individual periods of unavailability of less than 7 days, or for any free advertisements.
Payment for chargeable advertisements must be made at the time the advert is placed, and before the advert is displayed. Any refund of payments as above, or for any other reason, shall be made entirely at the discretion of The Company.
Once payment for an advert has been made and the advert has been published on the website you may delete or cancel your advert at any time, however no refund will be made for any unexpired period of the advertisement.
Only one trailer or trailer spare part may be entered per advert and offered for sale. Goods may not be advertised in more than one section unless agreed in advance. Adverts displaying links to EBay or other auction sites are not permitted and will be removed or amended at the discretion of the company. The item advertised may not be changed without the permission of the company. If a second item is to be advertised, a second advert must be entered.
You may not redistribute any content from this site for personal or commercial gain, or to the commercial detriment of The Company by any means. The Company retains all ownership, title and interest to the contents, database, copyright and facilities, except as expressly licensed by the company from third parties. The Company accepts no responsibility for the accuracy of any advertisement contained within The Site. The Company accepts no responsibility for any decision or act of any person based on the contents of the site. It is the purchasers, or prospective purchaser’s responsibility to verify any claims or statements before acting on them or entering into any contract. Advertisers will ensure that their advertisements are legal, decent, inoffensive, honest and truthful.
The Company has the right to refuse publication of any advertisement for any reason. The Company may remove published advertisements from The Site at any time if it believes that any of these terms have been breached.
The Company reserves the right to modify any advertisement to ensure it meets the conditions of this agreement. The Company does not guarantee insertion, position, or appearance of any advertisement. Advertisers will ensure that all images submitted with advertisements will depict the item being advertised for sale. No images shall depict trailers or items owned by others.
Advertisers will ensure that all images will be free from copyright, and may only be submitted with the photographers’ permission. It is the advertiser’s responsibility to ensure that these conditions are met. The Company will remove any advertisement, whether published or not, where it is discovered that false information was submitted on the application form.
You agree that you are responsible for the security and use of any user names or passwords needed to access or use the site. You must take all reasonable steps to ensure that these user names and passwords are kept confidential and secure and you do not allow any unauthorised person to access The Site using your user name or password. The company accept no responsibility for the operation or content of any third party web sites linked to by The Site.
The Advertiser agrees to indemnify The Company in respect of all costs, damages, or other charges falling upon The Company as the result of legal actions or threatened legal actions arising from the publication of the advertisement. The Company will not be responsible for any loss resulting from technical failures, or the inability of you or other users to access the site. In no event will The Company be liable for any direct, consequential, incidental, or special damage or loss of any kind (including without limitation loss of profits, loss of contracts, business interruptions, loss of or corruption to data) however caused and whether arising under contract, tort, including negligence or otherwise.
If any exclusion, disclaimer or other provision contained in this Agreement is held invalid for any reason and The Company becomes liable for loss or damage that could otherwise be limited, such liability, whether in contract, negligence or otherwise, will not exceed the amount actually paid by you to The Company. The Company does not exclude or limit liability for death or personal injury resulting from an act negligence of The Company.
Buyers
- Unless otherwise stated, items are sold as seen.
- If you have the item collected by someone else and have not inspected it yourself, it is your responsibility to make sure the item is working as described before despatch.
- Any disputes are between you and the seller. If there is an issue, in the first instance try to deal with it between you both amicably. Failing that and depending on the issue, there are civil remedies, Trading Standards or the police. If you think that an advertiser is a scammer, trading illegally etc. then please notify us and if appropriate we will suspend or remove their adverts and access to the site.
- Assume that all prices are +VAT unless otherwise stated. If VAT is charged, then the seller must by law supply you with a VAT receipt that contains their VAT registration number if you request one.
Sellers
- All adverts are the responsibility of you the advertiser. We accept no responsibility for the accuracy of the advert in relation to the item for sale. Please take care to ensure that you do not infringe any copyright or trade name. Any copyright or trade name disputes that occur as a result of an infringement in your advert will be between you and the copyright holder, we accept no responsibility for any breaches that you may make.
- We reserve the right to exclude, alter or remove any advert that we feel is inappropriate or illegal and reserve the right to suspend your account and supply any information to law enforcement agencies or third parties where appropriate and subject to court orders being supplied if required.
- If there is a legal obligation to restrict the sale of any goods, you agree to comply by the restrictions. For example, age restricted products such as (but not restricted to) glue and knives. For example, (but not limited to) Children and Young Persons Act 1933, Video Recordings Act 1984, Intoxicating Substances (Supply) Act 1985, Criminal Justice Act 1988, Children and Young Persons (Protection from Tobacco) Act 1991, Offensive Weapons Act 1996, Cigarette Lighter Refill (Safety) Regulations 1999, Anti-social Behaviour Act 2003, Licensing Act 2003, Fireworks Regulations 2004, Gambling Act 2005, Violent Crime Reduction Act 2006, Pyrotechnic Articles (Safety) Regulations 2015
- We will not be held responsible for any delay in advertising your items. Any down time of the site, be it for maintenance or otherwise, will be limited to the shortest time possible. In the event of a site crash, or the site closing down, the maximum liability we will accept is returning the advertising fee on a pro rata basis, this will be at our discretion.
- Once listed, we do not offer refunds on your advert. For example, if you place an advert with us but then change your mind and don’t want to sell your item or, the next day your item sells through the local paper we will not be able to offer a refund.
- You agree to allow us to use any photograph, or text used in your advert to advertise your item on our Facebook page or our other websites. These may remain on such websites even after your item has sold.
As buyer and seller you are making a contract between both of you. Trailermart.co.uk and Niche Websites Ltd do not accept any liability for anything bought from or through or facilitated by our website.
Payment
We do not store credit / debit card details. We do not and will not share our customer details with any 3rd parties unless this is for civil or criminal investigation purposes and we are under a legal obligation to do so.
We use PayPal for our payment processing. PayPal is a highly regarded secure payment gateway and they operate under their own rules and regulations. Please visit the PayPal site for further information if required.
The fee you pay for advertising with us will allow your advert to stay on the site until sold or the site closes, unless we feel that your pricing of the item for sale is completely unrealistic (EG you are trying to sell a spare part for a very high price, or an old trailer for far more than its market value) in which case we reserve the right to ask you to amend it or to remove it or to do so ourselves. If we suspect that your item has sold and we have been unable to contact you after 2 attempts, we reserve the right to remove it.
In order to keep our payment processing costs to a minimum and reduce our fees, the advertising fee you are paying is for 7 days. In reality there is no time limit for your advert to remain on the site (except for the reasons already mentioned) but we have been informed that in the unlikely event that we cease trading, the servers or the site crashed etc. then those customers who paid for adverts by card may potentially be eligible for a refund from the card processor. The longer this refund period is, the higher the processing charge is that we have to pay to the card processor. The shorter the period, the lower the cost to us. This means that if we do not limit the period to 7 days the repayment liability could extend back quite some time and be unreasonably expensive. In order to mitigate this and ensure that our charges to you can remain low, the advertising period you are actually paying for is 7 days.
